Terms of Service

Last updated: April 28, 2026. These terms are a launch-ready baseline, not a substitute for jurisdiction-specific legal review.

Use of Achiote

Achiote helps reconstruct food and drink memories with structured research, provenance, sensory reasoning, and minimum viable nostalgia cues. You are responsible for deciding whether any suggestion is appropriate for your body, kitchen, ingredients, and local context.

Accounts and API keys

Keep API keys private. You are responsible for activity under your key. We may suspend access for abuse, security risk, excessive load, payment failure, or violation of these terms.

Guided-memory subscriptions

Hosted consumer plans are measured in guided memories, not public MCP-call bundles. API, MCP, production integrations, and commercial self-hosting require a commercial license or separate written approval. Plan limits may change prospectively, but active subscribers should receive reasonable notice before material reductions.

Refund and cancellation policy

Subscriptions should be cancellable through the billing portal or by emailing [email protected]. Refund requests are reviewed case by case; accidental duplicate charges, checkout mistakes, and unusable service incidents are the highest priority.

Acceptable use

Do not use Achiote for unlawful activity, credential theft, harassment, scraping, attempts to bypass limits, or advice that would create foreseeable harm. Do not upload content you do not have the right to process.

Availability

Achiote is provided as-is during launch. We aim to keep the hosted service reliable, but early-stage service may have downtime, provider outages, or model quality variation.

Disclaimer of warranties

Achiote is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or free of harmful components. Food-memory reconstructions are creative suggestions, not professional dietary, medical, or cultural advice.

Limitation of liability

To the maximum extent permitted by applicable law, neither Kyanite Labs nor its officers, directors, employees, agents, or affiliates shall be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or related to your use of or inability to use Achiote, regardless of the cause of action or the theory of liability, even if advised of the possibility of such damages. In no event shall total liability exceed the amount you paid to Kyanite Labs for the service in the twelve (12) months preceding the claim.

Indemnification

You agree to indemnify, defend, and hold harmless Kyanite Labs and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of Achiote, your violation of these terms, or your violation of any rights of a third party.

Intellectual property

Achiote and its original content, features, and functionality are owned by Kyanite Labs and are protected by international copyright, trademark, and other intellectual property laws. Your food-memory inputs remain yours. Generated reconstructions are provided for your personal use; commercial redistribution requires a separate license.

Governing law and disputes

These terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles. Any disputes arising from these terms or your use of Achiote shall be resolved exclusively in the state or federal courts located in San Francisco County, California, and you consent to the personal jurisdiction of such courts. You waive any right to participate in class-action lawsuits or class-wide arbitration.

Changes to these terms

We may update these terms from time to time. Material changes will be noted by updating the "Last updated" date above. Continued use of Achiote after changes constitutes acceptance of the revised terms. We encourage reviewing this page periodically.
